RE: The tariff classification of closet pole sockets

Dear Ms. Hiltpold:

In your letter dated May 25, 2011, you requested a tariff classification ruling.

The closet pole sockets, item number 75-6040, are composed of white molded plastics. The sockets are designed to be affixed to the closet walls by means of a single screw mounting. The closet pole can then be inserted into the sockets. The sockets are designed to fit poles measuring up to 1 3/8 of an inch in diameter. They will be packaged two to a set.

You have suggested classification in subheading 3925.20.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for builders’ ware of plastics, not elsewhere specified or included: doors, windows and their frames and thresholds for doors. The closet pole sockets are not similar to the products in that subheading.

You have not identified the country of origin. The rate provided below is the rate that is applicable to products manufactured in countries with which the United States has Normal Trade Relations.

The applicable subheading for the closet pole sockets will be 3925.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for builders’ ware of plastics, not elsewhere specified or included, other. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
